Terms of Service

These terms govern the purchase and use of software packages from Skagit Technologies.
By purchasing, accessing, or using any software package or service from Skagit Technologies ("we," "us," "our"), you ("Client") agree to these Terms of Service. If you do not agree, do not purchase or use the services.

01 Services & License

Skagit Technologies is an authorized reseller of business software, providing e-commerce software, marketing automation, and AI tools, together with configuration, onboarding, and support ("Services"). Upon purchase and payment, we grant the Client a non-exclusive, non-transferable license to use the delivered software and configurations for the Client's own business operations, subject to these Terms and any applicable third-party platform terms.

02 One-Time Fees

Packages are sold at a one-time price as stated at the time of purchase. Fees are due in full unless a written payment arrangement is agreed. Prices exclude any third-party costs (such as domains, payment-processing fees, or third-party subscriptions) unless expressly stated. All fees are quoted in U.S. dollars.

03 Acceptable Use

The Client agrees not to use the Services to:

  • Violate any applicable law, regulation, or third-party right;
  • Send unlawful, deceptive, or unsolicited communications;
  • Infringe intellectual-property rights or distribute malicious code;
  • Resell, sublicense, or misrepresent the software as the Client's own product without authorization; or
  • Interfere with or attempt to gain unauthorized access to any system.

We may suspend Services for conduct that violates this section or exposes us or third parties to liability.

04 Client Responsibilities

  • Provide accurate business information, access, and materials needed to deliver the Services;
  • Maintain your own accounts, domains, and payment-processor relationships;
  • Comply with all laws applicable to your business, including marketing, privacy, and consumer-protection rules;
  • Review and approve configurations before launch; and
  • Keep your own credentials, data, and backups secure.

05 Intellectual Property

All underlying software, platform technology, templates, and methods remain the property of their respective owners and licensors. Content you provide remains yours. The configurations and deliverables produced for your account are licensed to you for your business use; we retain ownership of any reusable tools, code, and know-how used to deliver the Services.

06 No Income or Results Guarantee

We do not guarantee any income, revenue, sales, traffic, or business result. The Services provide software and setup; outcomes depend on many factors outside our control, including your market, effort, products, and execution. Nothing in our materials should be interpreted as a promise or projection of earnings.

07 Limitation of Liability

To the maximum extent permitted by law, Skagit Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to the Services. Our total aggregate liability for any claim shall not exceed the amount actually paid by the Client for the specific package giving rise to the claim. The Services are provided "as is" and "as available" without warranties of any kind except as expressly stated in writing.

08 Refunds

Sales are final except as set out in our Refund Policy: a full refund is available within 72 hours of purchase, provided implementation has not begun. After that window, or once implementation has begun, all sales are final and non-refundable. See the full Refund Policy.

09 Term & Changes

These Terms apply from your purchase and continue while you use the Services. We may update these Terms from time to time; the version in effect at the time of your purchase governs that purchase. Continued use after an update constitutes acceptance of the revised Terms.
